Resort Fees Investigation
Migliaccio & Rathod LLP is investigating claims by consumers who were unaware of hotel resort fees when making their online reservation. Resort fees, which cover the cost of hotel facilities and services, are sometimes charged apart from a room’s total price and can be poorly disclosed, appearing either on the reservation’s fine print or on the confirmation screen, rather than during the booking process. These fees may also be labeled as “facility fees,” “destination fees,” “amenity fees,” or “urban fees.” A report published by the Bureau of Economics Federal Trade Commission concluded that consumers are likely to be harmed by the separation of resort fees from the total price of hotel rooms, since keeping the fees separate makes hotel price comparisons more difficult.
One expects to understand all of the charges displayed on a page’s confirmation page. A hotel’s sudden presentation of resort fees pose a potential deceptive trade practice and false advertisement, both of which have caught the attention of federal and state regulators.
(7/10/2019) D.C. Attorney General Karl Racine Sues Marriott for Deceptive Pricing Practices: When shopping for hotel rooms in hotel comparison websites, companies like Marriott don’t show the true price of their rooms until the customer has almost confirmed their reservation, upon which point additional fees are suddenly disclosed. According to the lawsuit, Marriott’s deceptive pricing has brought the company millions of dollars in profit over the last decade.
